Good evening, Jon.

JONATHAN TURLEY, CONSTITUTIONAL LAW EXPERT: Hi, Keith.

OLBERMANN: I’ve often argued here that even if you think the words aren’t going to lead to any action, say the words anyway, simply to get them on the record for history, and simply because nothing has ever changed from bad to good in this country without somebody first saying—this is bad. Assess the importance of what Dennis Kucinich did last night.

TURLEY: You know, it is very important. The fact is that this is not supposed to happen the way it happened in the last seven years. The framers, I think, would have been astonished by the absolute passivity if not collusion of the Democrats in protecting President Bush from impeachment. I mean, they created a system that was essentially idiot-proof and God knows we put that to a test in the past years.

But, I don’t think they ever anticipated that so many members of the opposition would stand quietly in the face of clear presidential crimes. It has many of us who study the Constitution quite worried that we have a real crisis here. This is not something that really was supposed to happen. It was not something that one would predict.

OLBERMANN: This is the list that he presented last night—a remarkably lengthy and thorough record of the high crimes and misdemeanors. It’s just a cascade really. Did Kucinich successfully make his case?

TURLEY: I think he’s made his case. I mean, frankly, some of these claims are not really impeachable offenses. Like for example, it’s not impeachable to be negligent. If that was the case, we’d lose half that people that sat in the Oval Office. But there are plenty of crimes there. This is a target-rich environment.

What’s really disturbing for many of us is that it takes a real effort for Democrats to walk from the floor to their offices and not trip over crimes. I mean, they are all over the record, from destruction of evidence, to illegal surveillance, to unlawful torture programs. They’re all over the place.

And what’s amazing is that the president is hiding in plain view. He hasn’t really denied the elements of these offenses. So, all that is lacking is political will.

But that doesn’t mean that suddenly the Democrats are going to get principled and say—my God, we took an oath, and we need to fulfill it regardless of the outcome. But it does mean one member, and they’re actually more than one, are really calling their colleagues to the floor and saying—it’s time to pony up. It’s time to answer the public of whether you stand for the Constitution and against its abridgement.

But with the power of truth and the power of the people we can achieve a new birth of freedom, standing up for what is good in America, insisting on the rule of law, demanding adherence to the Constitution, and supporting the impeachment of a President who lied to take us into a war against Iraq.

If you have followed this blog you realize I was a Dennis Kucinich believer when he was running for president. The main reason is that I believe him to be a patriot and a true believer in Democracy and his oath of office. I believe that he sees the injustices and crimes that the Bush cabal have conducted and has not been afraid or politically motivated to keep quiet.

So there is a huge applause from America that he did it and hopefully if it is tabled again, America will finally be outraged that they are not doing their job. I am so pleased that Keith discusses this issue with Jonathon Turley (as you know, I post a lot of his stuff here… very funny man and a constitutional genius).

Our effort to hold the Bush/Cheney Administration accountable has taken another dramatic step forward. Last night, Congressman Dennis Kucinich introduced the first Articles of Impeachment ever to be introduced against President Bush.  It includes, in total, thirty-five Articles detailing this Administration’s blatant abuse of power. Today, I enthusiastically co-sponsored this vitally important bill.

This courageous bill is a crucial step towards fulfilling this promise, but – like the Articles against Cheney – they require your support to convince Democrats and open-minded Republicans to support this bold but necessary action.

I contend that time matters not. These people, especially Bush, have broken untold laws, far more than any other president in our history. If there was ever a case for impeachment, this is it.

He introduced Articles of Impeachment this evening for Bush. From The Raw Story:

Kucinich presents Bush impeachment articles

An Ohio Democratic lawmaker and former presidential candidate has presented articles of impeachment against President George W. Bush to Congress.

Thirty-five articles were presented by Rep. Dennis Kucinich to the House of Representatives late Monday evening, airing live on CSPAN.

“The House is not in order,” said Kucinich to Speaker Nancy Pelosi (D-CA), upon which Pelosi pounded her gavel.

“Resolved,” Kucinich then began, “that President George W. Bush be impeached for high crimes and misdemeanors, and that the following articles of impeachment be exhibited to the United States Senate. …

“In his conduct while President of the United States, George W. Bush, in violation of his constitutional oath to faithfully execute the office of president of the United States, and to the best of his ability preserve, protect and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed, has committed the following abuses of power…”

The first article Kucinich presented, and many that followed, regarded the war in Iraq: “Article 1 - Creating a secret propaganda campaign to manufacture a false case for war against Iraq.”

Mike Gravel Campaign

This blog participated in an April Fools Day joke that was really not a joke (at least, so I thought when I signed up… nor did any of my compatriots). This “joke” was to be a way to wake up Americans to an Initiative that Mike Gravel is sponsoring and to illuminate his campaign and ideology.

I have come away from this experience with a second lesson learned when it comes to “second tier” or “third party” candidates… their campaigns suck. Period. Maybe that is the nature of the beast. Maybe, since the 1st Tier” candidates are sucking in all the bucks, they can attract the real talent and no matter how much people like me want to help… we don’t have the skills, apparently.

I witnessed the same thing with the Kucinich Campaign for President. As much as I agree with the content and ideology of Mr Kucinich (I even gave money for his congressional campaign) I found that the campaign was lacking horribly. This is not an attack against the people, but an another acknowledgment that the election process is screwed.

My “peeps” seem to understand that a third party candidate stands no chance at winning, but we are just as intent on getting visibility to these third party candidates. But I come away from this endeavour frustrated and angry because I do not like wasting my time or depending on someone that is incompetent or uninterested (for I am not sure what happened in this case).

All I know is that this election cycle has pissed me off, more because no matter how much I try, the MSM has a program and I can’t seem to change the channel.

So, should I join the Obama bandwagon? No. To hell with him. Screw the Dems and Thugs. And the Indys, if they are going to be inept.

How in the hell does an Indy think he will get elected going up against such a well-oiled machine? Damn near impossible, especially with the likes of the situation I experienced yesterday?

Fox News Explains Who The Best Anti-Terrorist Presidential Candidate Is

The former head of the CIA’s bin Laden unit Michael Scheuer appeared on yesterday’s Hannity & Colmes to give his opinion about what candidate would be best at fighting the war on terrorism.

After airing a clip of McCain criticizing Obama’s plan on fighting terror, Rich Lowry (who was filling in for Hannity) asked Sheuer, “Is either of them right?”

“I think both of them (McCain and Obama) are equally unable to cope with the threat represented by Osama bin Laden, al Qaeda, and the Islamists,” Sheuer responded. “They really don’t have a clue about what this war is about.”

He continued, “Mr. McCain is very confident, but he’s clueless. Mr. Obama is equally clueless.

“They continue to tell Americans, ‘These people are Islamo-fascists, and they hate us because of our freedoms,’ and ‘they hate us for our liberties.’

“What they hate us for is the unusually virulent strain of obsessive compulsive disorder that’s present in the American governing class, and that’s called interventionism. That’s what the cause of this war is. And neither Mr. McCain, nor Mr. Obama, nor Mrs. Clinton, nor any of the rest of them who are in the campaign—except Mr. Paul, Mr. Kucinich perhaps—had that idea.”

Dennis Kucinich Update

I believe that America’s biggest loss this year is that Dennis Kucinich was successfully barred from participating in the presidential election. Big Money has this thing wrapped up nice and tight (and purty for all you rednecks enamored by the shiny spectacle). I have continued to give to his campaign, even after he was strong-armed out of the presidential race (with the Democratic Party’s complicit participation). From Freedom Rider’s Blog:

Dennis Kucinich has now raised more money than his main challenger, Joe Cimperman. Kucinich raised nearly $700,000 in the last six weeks and he now has more cash on hand than Cimperman. You can see the Federal Elections Commission chart here. Candidates are listed in alphabetical order.

This is not just good news for Dennis. It is good news for democracy. We already know that Bush will win November, because he has achieved his goal of silencing the Democrats for good. The system is rigged, guaranteeing that the eventual Democratic nominee will not deviate from his awful legacy.

A Kucinich victory will reverberate across the nation. The few progressives in Congress must not be picked off by Pelosi and her check bundlers. Dennis has to win and so far the signs are good.

Kucinich is a “black” congressional candidate

In his presidential campaigns in 2004 and 2008, Ohio Congressman Dennis Kucinich told Democrats a brutal truth. Party orthodoxy is a disaster, a series of lies that must no longer be accepted. While his opponents, Obama, Clinton and Edwards, made it clear they weren’t serious about ending the occupation of Iraq, Kucinich presented a plan to do just that. When they made the case for leaving a failed for-profit health care system intact, Kucinich said that non-profit universal care was possible. He co-sponsored legislation calling for impeachment hearings against Vice President Cheney and President Bush while leadership declared the criminals should go free.

While Barack Obama garners 80% to 90% of black votes in the primaries, it is the Kucinich platform that actually expresses the political opinions of most black Americans. Disavowal of American military aggression and support for government enforcement of legal and civil rights of citizens are the hallmarks of Kucinich’s history. Obama makes eloquent but empty speeches bereft of specifics. In contrast, Kucinich’s national political life appeared to be over shortly after it began because he took a courageous stand against corporate power.

Elected mayor of Cleveland in 1977, Dennis Kucinich refused to allow a privately owned electrical utility to purchase that city’s publicly owned utility. In an effort to force the sale and thereby create a monopoly, banks refused to extend the city any credit and plunged it into default. Kucinich paid the price for his principles when he was defeated in his re-election effort. Years later Kucinich was vindicated, having stopped what would have been an enormous corporate theft of public money and services.

Kucinich returned first to the Cleveland City Council, then the Ohio state legislature, and in 1996 he was elected to Congress. Despite his vast experience, he was forced to drop out of this year’s presidential race. The lack of media and debate access were not his only problems. He faces a fierce challenge that once again puts his political survival in jeopardy.

In December 2007, Cleveland City Councilman Joe Cimperman declared himself a challenger for Kucinich’s congressional seat. Within fifteen days, Cimperman raised more than $39,000 from fifteen contributors, none of whom reside in the 10th District that is being contested. Cimperman is no different from these contributors. He doesn’t live in the district either but that doesn’t matter to the lawyers, bankers and real estate developers who are giving him money. They expect access and influence. Cimperman’s address, like the interests of residents, is of no importance to them.

Cimperman supporters are not alone in wanting Kucinich out of office. Cleveland’s daily newspaper, the Plain Dealer, endorsed Cimperman, and didn’t mince words about wanting Kucinich gone.

Kucinich repeatedly has defied House Speaker Nancy Pelosi.”

“Congress runs on relationships and loyalties. Yet Kucinich repeatedly has defied House Speaker Nancy Pelosi and her leadership team [emphasis mine] by not supporting their attempts to impose a deadline on U.S. involvement in Iraq - even when those attempts were part of realistic bipartisan proposals to recalibrate a policy he detests.”

Support for Nancy Pelosi and the awful Democratic Congressional leadership should not be held up as the standard for political success. After declaring that Kucinich’s principles aren’t worth supporting, the Plain Dealer heaps further insult by comparing Kucinich to Democrats who win approval by failing the people. Barney Frank is used as an example. “. . . he knows when and how to cut a deal. He delivers [emphasis mine] for his party, his constituents and his beliefs.”  

Citizens never benefit from what Barney Frank or Nancy Pelosi would call victory. There is no bipartisan recalibration with the Bush regime. Bush still gets what he wants from Democrats. They fund the Iraq occupation, support trade deals that endanger American workers, refuse to rebuild the Gulf Coast, and say nothing when administration officials ignore their subpoenas. Because acquiescence is equated with political rectitude, Kucinich flunks the test.

“Kucinich was the only progressive in the presidential campaign.”

So great is the pressure to get rid of Kucinich, that Cleveland’s Mayor, Frank Jackson, also endorsed Cimperman. Elected officials usually endorse incumbents, or refrain from making endorsements altogether. The pressure to get rid of Kucinich is overwhelming.

The Democratic leadership has a history of punishing their own who dare to oppose Republicans. Cynthia McKinney was twice sent packing from Congress because she wouldn’t toe the line. Now it may be Kucinich’s turn.

Kucinich is a “black” congressional candidate. He was the only progressive in the presidential campaign. His re-election should be the first priority for activists in this presidential campaign year. Imagine a Congress with no voice for impeachment. Imagine Congress with no questions about Iraqi civilian casualties. Imagine a Congress without Kucinich when Bush decides on his pretext for war against Iran. Imagine the worst, because that is what we will have if Kucinich is defeated.

Another Day, Another FISA Veto Threat By The Bully In The White House

Yesterday, Bush again put the self interest of himself and his giant telecom criminal co-conspirators above our national security, by threatening to veto the FISA update bill unless we gave them all get out of jail free cards. And if Congress were to bend over yet again, he would still probably veto it to demand even more changes and/or defy other major provisions with a signing statement, as he so outrageously did with the recent defense bill.

We must be just as relentless as the criminals who are working overtime to gut our constitution. We have had two successful filibusters so far, and it looks like we’re going to need a third.

And we need strong opposition in the House too, for that is our last bulwark.

The latest scam they are trying to run down on the American people is to retroactively lower the liability bar to some kind of flimsy “good faith” standard, the clear intent of which is to ensure that the telecoms get off the hook, another snaky end run around the law.

Suppose a bank robber told a judge he had a good faith belief it was his own money. How far would that one fly? What part of NO immunity don’t they get?

The American people deserve to know how far this is gone. We are not going to allow one of the most precious amendments in our Bill of Rights, the protection against unwarranted search, to be swept under the rug. And even beyond that, informed commentators believe that creating the Big Brother database of Cheney’s dreams would in fact invite a nightmare of new national security vulnerabilities.

Dennis Kucinich Is Still Standing Strong

And what greater hero do we have than Dennis Kucinich, still standing strong as ever on every issue that matters. Here is his own leadership statement opposing telecom immunity

The veto threat by the President is just the latest example of the use of fear and intimidation — in the name of “national security” - to secure legislative authority to violate the Constitutional rights and protections of American citizens. I strenuously object to any immunity for telecommunications companies and demand a full accounting of these companies’ involvement to Congress and to the American public. When corporations cooperate with the government to strip people of their Constitutional rights, that is a textbook description of fascism. There must not be any place in America for this type of conduct.

And yet, even now, powerful corporations are pouring money into Dennis’s district, to try to buy his seat out from under him by threatening him in his own primary. They are running malicious attack ads in heavy rotation. Please consider making a donation to Dennis now, to help him fight back.

Washington — After promising to mark President Bush’s final State of the Union speech by introducing articles of impeachment against Bush, Cleveland Democratic Rep. Dennis Kucinich postponed the effort.

Kucinich said Monday that he met with members of the House Judiciary Committee after making last week’s impeachment pledge. He said he came away “hopeful there will be an inquiry by the Judiciary Committee.”

“I will give them the opportunity to proceed before introducing articles of impeachment,” he said in a statement. The committee’s spokeswoman did not respond to requests for comment.

Last year, Kucinich introduced a measure to impeach Vice President Dick Cheney that has collected 24 co-sponsors. His effort to bring the matter before the full House won support from Republicans who wanted to embarrass House Demo cratic leaders, but eventually was referred to the Judiciary Committee.

Kucinich told The Plain Dealer editorial board last week that nine of the Judiciary Committee’s 40 members favor his bid to impeach Cheney.

“I do not believe that there will be an impeachment this year — I don’t think that will happen — but I do think that the questions relating to an inquiry of both the president and the vice president are important so that our nation has a real understanding of the effort that was made, a consistent effort, to mislead the people into supporting a war,” he said.

Big Money Wins Again

They pulled it off. They were able to totally squash the message and now are fighting him for his local congressional seat. We are losing the most clear voice towards reconciliation towards peace, honor and standing in the world. The one with the most clear vision of prosperous future, understanding that the Corporate (Big Money) interests are causing our demise.

But it is also Joe Blow’s fault for not realizing he has been duped.

But never understand that the dream is always just out of reach. You are likely as bad, if not worse off than you were 7 years ago. I know that I am.

So Dennis is forced to pull out, for even the courts are set against fairness and now give TV companies and their owners precedence over the actual candidates view.

We have allowed corporations to decide who the candidates are for us.

New Hampshire Election Recount Suspicious

From Black Box Voting Forum Bev Harris gives us an update on suspicious activity with the recount. Does one have to be a conspiracy theorist to look at these things and see discrepancy and problems and be suspicious to motive? Am I some “super-sleuth” to suspect wrong-doing?

No worries, say New Hampshire officials when cuts up to eight inches long are spotted in newly delivered ballot boxes. “The only seal that counts is the one on top.”

Except the seal on top can be peeled off without leaving a trace, then reaffixed.

Black Box Voting has been doing a chain of custody exam for the New Hampshire Primary’s recount. On Wednesday night, Election Defense Alliance’s Sally Castleman mentioned a troubling observation: After following the ballots back to the ballot vault following Wednesday’s recount, she had the opportunity to enter the ballot vault, and noticed what looked like cuts, or slits, in the side of many ballot boxes. New Hampshire officials assured us that these cuts, which slice through the tape and seals do not permit access to the uncounted ballots, pointing to a label on the boxtop which they call a seal.

But the “seal” can be removed, like a Post-it, and reaffixed. So it’s not a seal all!

We wanted to know if the ballot boxes were slit while in the vault, in the transport van, or came from the towns with slits in them.

I confirmed this morning that many if not most of the boxes scheduled to be counted today had slits in them. I went out when a vanload of ballots arrived, and saw that they were slit at the time they arrived by van. Susan Pynchon and I drove to two nearby towns and watched as they handed over their ballot boxes to “Butch and Hoppy”, the two men who drive around in the state in a van picking the ballots up. We observed as they loaded boxes of ballots into the van with no slits at all in them. We videotaped each of these up close. They arrived at the destination without slits. The label on the top was affixed, but in some cases was crumpled, or also damaged.

Of cource, the label affixed to the top can be removed and reattached without telltale signs.

No vault tonight

A significant departure from the normal chain of custody path occurred tonight. They decided not to use the vault to store the ballots.
